What Everyone Needs to Know About Section 504 of the Rehabilitation Act of 1973

Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act are federal laws intended to assure equal access to publicly funded agencies and organizations, including public schools, public academies, and charter schools.

Haslett Public Schools provides general education accommodation plans under the provisions of Section 504 of the Americans with Disabilities Act.  Your child may possibly be eligible and possibly qualify for an accommodation plan to address his/her educational needs in school. Who Is a Person With a Disability Under 504? Section 504 defines a person with a disability as “any person who: (i) has a physical or mental impairment which substantially limits one or more major life activities, (ii) has a record of such an impairment, or (iii) is regarded as having such an impairment.” To determine disability status, districts are to follow five “rules of construction” in implementing this definition: 1. above definitions to be construed broadly; 2. substantial limitation does not mean prevent/severely restrict; 3. only need a substantial limitation in one major life activity; 4. determine limitation when episodic impairment is active; and 5. determine limitations without regard to mitigating measures.
